The tire, which was on a relatively new rental vehicle, how become weakened due to having been run in an under inflated condition for nearly 10,000 miles. The tire’s under inflation, which was shown to have been the result of the rental car company’s failure to properly inspect and maintain its vehicles, caused an internal heating condition to occur eventually resulting in sidewall separation of the tire, causing a sudden air-loss/blowout. After demonstrating serious wrongdoing on the part of the rental car company in maintaining the tire per manufacturer’s specification, Berman & Riedel, LLP, was able to negotiate settlement for the parents of the young boy who was killed in an amount in of $2,450,000.00.

In another case, the firm represented a client who suffered significant damages after being involved in a single vehicle accident five miles after he left a tire repair shop. After having his tires repaired, the front right tire of the vehicle fell off while the client was entering into the slow lane of traffic after enter the freeway from the on-ramp.
