The San Diego based personal injury firm of Berman & Riedel, LLP, which handles claims for injured victims throughout the entire State of California, has established itself as one of the leading California firms in handling tire failure cases. The firm has been lauded for its tremendous successes in handling serious personal injury and wrongful death claims caused by sudden tire failures, whether cause by poorly designed and manufactured tires or through the improper use, matching, application or repair of commonly sold tires.

Notwithstanding the difficult liability issues that present in almost every tire failure case, the attorneys at Berman & Riedel, LLP, have developed a uniquely strong understanding and appreciation for the issues that require proving the underlying cause of a tire failure. Whether such issues involve the improper design, poor construction or incorrect manufacturing involved with the failed tire, or whether the failure was caused through the negligent sale, application, installation or repair of the tire, the attorneys at Berman & Riedel, LLP, work with the absolute best experts involved in this highly specialized area of practice to establish and prove liability. The results obtained by the firm in handling such tire failure cases have proven tremendous.

In one case for example, the firm represented the parents of a promising young athlete who was tragically killed when the front right tire on his newly purchased vehicle failed after only 9,000 miles of use. Through extensive investigation, and in working with the best tire experts in the country, the attorneys at Berman & Riedel, LLP, were able to establish a series of errors that contributed to the failure of the tire, including: (1) the poor design of the tire, (2) a history of tire failures with the same brand tires, (3) failure by the aftermarket seller to properly match the tires to the vehicle for which they were purchased, and (4) a failure on the part of the installer to recognize that the tires were unsuitable to handle the load (weight) of the vehicle for which they were being installed. The series of events by several companies involved resulted in a tread separation within the tire which ultimately caused the tire’s carcass to fail. After demonstrating serious wrongdoing on the part of the three companies involved with design, sale, and installation of the subject tire, Berman & Riedel, LLP, was able to negotiate settlement for the parents of the young boy who was killed in an amount near $7,000,000.00.

In another similar case, the firm represented the parents of a 6-year-old boy who was tragically killed when he was thrown from the vehicle in which the family was traveling after the left rear tire failed. The tire, which was on a relatively new rental vehicle, how become weakened due to having been run in an under inflated condition for nearly 10,000 miles. The tire’s under inflation, which was shown to have been the result of the rental car company’s failure to properly inspect and maintain its vehicles, caused an internal heating condition to occur eventually resulting in sidewall separation of the tire, causing a sudden air-loss/blowout. After demonstrating serious wrongdoing on the part of the rental car company in maintaining the tire per manufacturer’s specification, Berman & Riedel, LLP, was able to negotiate settlement for the parents of the young boy who was killed in an amount in of $2,450,000.00.

In another case, the firm represented a client who suffered significant damages after being involved in a single vehicle accident five miles after he left a tire repair shop. After having his tires repaired, the front right tire of the vehicle fell off while the client was entering into the slow lane of traffic after enter the freeway from the on-ramp. Despite an aggressive defense where the repair shop attempted to place blame on the client, Berman & Riedel, LLP, was able to conclusively demonstrate that the accident was caused as the sole result of the repair shop to properly secure the tire to the vehicle. The case settled for a significant but confidential amount.
