LOS ANGELES, CALIFORNIA – On Tuesday, January 13, 2009, 5 more lawsuits related to the Metrolink commuter train crash that killed 25 people last September were filed in the Downtown Branch of the Los Angeles Superior Court. These additional suits were brought forth by survivors and family members of victims killed in the accident. Named in the new wrongful death lawsuits is the regional rail authority that operates Metrolink, a contractor that provides engineers who run the Metrolink trains and its parent company Veolia Transportation.
The new claims allege negligence and seek general and punitive damages. One of the lawsuits filed by a survivor of the crash alleges the defendants knew the engineer was not competent to operate the train. Records show that the engineer of the Metrolink train, Robert Sanchez, was text messaging mere seconds before the accident occurred. The suits are among many that have already been filed, and even more are expected to be filed.
